Opinion
Representing an absolute definition and clear instances of crime that can be acceptable by all societies and cultures in our world or contemporary era, is very difficult or impossible. Pay attention to the following points can clarify this issue.
i. Crime cannot be defined as the elements of Mendeleev’s table or the principals of light reflection, mathematics, physics, chemistry, and similar cases that are measurable and testable.
ii. In social science and humanities, any definition, judgment, and conclusion are related to complex factors, so against experimental sciences, reaching a clear, pure, and comprehensive acceptable conclusion is very difficult or impossible.
iii. If the characteristics of the elements of Mendeleev’s table or the foundations of mathematics and physics were related to cultural, economic, social, religion and other similar factors - for example, the atomicity or valence of hydrogen could vary up to 5 instead of 1, or there was no defined model for DNA structure. Could we imagine the state of the world and our life even for a moment? It seems that it was not possible to imagine such a world even hypothetically and imaginatively.
iv. On the other hand, if the definitions of human right and cultural, political, legal and social contract or principals were like the principals of physics, mathematics and chemistry, and for example, if a person, due to not accepting the gravity, tries to walk from a height of 10 meters Hitting in the open air, let go! it would lead to his downfall and death, just as if he did not follow a social or cultural contract or principal, he would suffer blindness or deafness or death according to the rule of nature. In such a hypothetical world, do words such as crime, violation and deviation have any meaning or concept?
v. Irrespective of the philosophical viewpoints and explanation subjects as free will or determinism or autonomy in relations and human sciences, the requirement for the diversity of human thoughts, ideas and cultures is that human laws and contracts are also diverse and these diversities differs from one person to another and from one society to another. This diversity can be assonant, parallel, contrary to different intensities or completely opposite. In compatible and parallel cases, human relations can be established in a peaceful coexistence, in cases of contradiction, depending on the intensity and the degree of difference, human relations can appear as a lack of understanding, verbal confrontations, and temporary or long-term tensions, and finally, in cases of all-round opposition of views, the possibility of a complete severance of relations to serious, intense and all-round verbal and physical tensions and confrontations is unavoidable and this situation will continue until an understanding each other and peaceful coexistence reached.
vi. An event in a specific country, time, , situation or culture from the view point of human rights may be firmly recognized as a crime, but from another view point based on specific culture or school, recognized as a courage, humanity and chivalry or praiseworthy. Examples of this issue can be seen at any time and place throughout history, and in the contemporary era.
vii. Despite the existence of the United Nations and human rights institutions in all countries, countless examples of these contradictions can be seen in every country and culture. It may be said that there are topics and concepts that all human beings agree on as crimes and we can focus the discussion and study on them, but with a little attention and concentration, we find that homicide, robbery or harming children, elderlies, the disabled and even destroying the environment, which is expected to be condemned by all cultures and human right organization and known as prosecuted crimes , it can still be overlooked or appreciated by some subcultures and countries in contemporary era. Behaviors of ISIS, depriving girls and women from education and work, encouraging people to internal and external conflicts, all of which are examples of criminal acts based on specific and bizarre definition of humanity and human relation.
viii. In the field of medicine, many different criminal methods and practices are used under popular and folklore titles, some of which can be identified and prosecuted with great care and others only with specialized evaluation, but there are many cases of these cases. who continue to work after receiving legal and official permits.
ix. In the fields of economy, industry, engineering, urban planning, art, agriculture, literature, poetry and music, politics, environment, nutrition and health, ideology and religion, general and specific ethics, and in general, In every branch related to the world in which we live, criminal acts and actions are committed by various sources, many of which, for various reasons, are never revealed, and the perpetrators of those acts may be rewarded and be encourage.
x. One of the main duties and missions of researchers is to identify and introduce documented and accurate cases related to their expertise in scientific research publications to solve problems and prevent further abuses.
